By accessing or using our gaming facilities, website, or any services offered by AusGamer Club (collectively, the "Services"), you agree to be bound by these Terms of Service. Please read these terms carefully before using our Services. If you do not agree to these terms, please do not use our Services.

These terms constitute a legally binding agreement between you and AusGamer Club regarding your use of our gaming club, facilities, equipment, and related services. Our Services are designed to provide a premier gaming experience in Australia, and these terms help ensure that all members and guests can enjoy a safe, fair, and enjoyable environment.

2. Membership and Access

AusGamer Club offers various membership options and pay-as-you-go services. By purchasing a membership or accessing our facilities, you agree to the following:

• You must be at least 13 years of age to use our facilities. Users under 18 must have parental consent and may be subject to additional restrictions.
• Membership is personal and non-transferable. Sharing membership credentials or allowing others to use your account is prohibited.
• We reserve the right to refuse service, terminate memberships, or restrict access to anyone who violates these terms or engages in disruptive behavior.
• Members are responsible for maintaining the confidentiality of their account information and for all activities under their account.
• Special events and tournaments may require additional registration or fees, which will be clearly communicated.

3. Rules of Conduct

To ensure a positive experience for all users, we expect all members and guests to adhere to the following rules:

• Treat all staff and other users with respect. Harassment, discrimination, or abusive behavior will not be tolerated.
• Handle all equipment with care. Users may be held financially responsible for damage caused by misuse.
• Food and drinks must be kept in designated areas only. No food or drinks are permitted near computer stations or gaming equipment.
• Illegal activities, including copyright infringement, unauthorized software installation, or hacking attempts are strictly prohibited.
• Offensive content, including explicit imagery, hate speech, or content that violates our community standards may not be displayed or shared.
• Noise levels should be kept reasonable, and headphones must be used when requested by staff or other users.

4. Payments and Refunds

Payment for our Services is governed by the following terms:

• All fees and charges are displayed at our facility and on our website, and are subject to change with reasonable notice.
• Recurring membership fees will be charged automatically until membership is cancelled.
• Refunds for membership fees are available within 7 days of purchase if you have not used the facilities during that period.
• Event and tournament fees are generally non-refundable unless the event is cancelled by AusGamer Club.
• For technical issues that significantly impact your session, our staff may provide compensation in the form of additional time or credit at our discretion.

5. Equipment and Facilities Use

Our gaming equipment and facilities are provided subject to the following conditions:

• Gaming stations and equipment are provided on an "as is" basis. While we maintain our equipment regularly, occasional technical issues may occur.
• Installing software, modifying system settings, or tampering with hardware is prohibited without staff permission.
• Personal data should not be stored on our computers. Files left on our systems may be deleted without notice.
• We are not responsible for lost, stolen, or damaged personal belongings brought into our facilities.
• The use of our network for excessive downloads, illegal activities, or in violation of our acceptable use policy is prohibited.

6. Intellectual Property

All content, design, graphics, logos, and service names related to our Services are trademarks of AusGamer Club or our licensors. You may not use these without prior written permission.

User-generated content, such as tournament recordings, streaming content, or social media posts created within our facilities, is subject to the following:

• By creating content in our facilities or during our events, you grant us a non-exclusive license to use, display, and promote such content for marketing purposes.
• You retain ownership of your original content but must ensure it does not infringe on others' intellectual property rights.
• Content that violates copyright, trademark, or other intellectual property laws must not be created or shared using our Services.

7. Limitation of Liability

To the maximum extent permitted by applicable law, AusGamer Club and its affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data.
• Any harm resulting from your access to or use of our Services, including computer viruses or system failure.
• The conduct of other users or third parties, including disputes between users or instances of harassment.
• Service interruptions, technical issues, or inability to access our facilities or online services.

Our total liability for any claims under these terms shall not exceed the amount you have paid to us in the six months preceding the claim.

8. Dispute Resolution

In the event of a dispute related to these Terms or our Services:
